After Dad’s Demise, Married Daughter Eligible For Govt Job: HC

Kolkata: In a significant judgement, Calcutta High Court has ruled that married daughter can also claim government employment in the event of her father demise. Until now, the benefit in Bengal was limited to son married or bachelor and unmarried daughter.

A three judge division bench comprising officiating Chief Justice Nishita Nirmal Mhatra, justice Dipankar Dutta, and justice Tapabrata Chakraborty today altered this and ruled that similar to son, daughters irrespective of their marital status will be eligible for employment in case of father’s death during service.

The ruling came in response to a petition by Purnima Das of Birbhum, who had applied for a state government job after her father died but was denied saying that the state government rules do not permit this as she is married. State government had cited Gazette notifications issued by the panchayat, and labour departments in 2008 for this.

Today, the division bench headed by Chief Justice Mhatra termed the notifications “unconstitutional” and asked the state government to rectify it by dropping the term “married” in case of daughter eligible to claim employment after her father’s death.
