Kolkata: Calcutta High Court division bench of justice Debashish Kar on Friday dismissed SAT’s report which has stated the Dearness Allowance is not the right of the employees rather a relief by government. But the court has criticised and dismissed the facts and figures provided by them.
According to ROPA Act, DA is the right of the employees. State government supposed to get the Dearness Allowance.

But there are two issues which are sent back to SAT for reobservation that, the scale of DA will be similar to Central Government or a separate set of rules will be set for the State Government employees. The other part that draw the attention that those who are working outside of the state they get paid in accordance of the concerned state.
Previously, West Bengal government has accepted the fifth pay commission in 2008 and implemented that accordingly. So State government has to abide by that and continue to give to give Dearness Allowance.
SAT has given two months time to recheck the facts and take the decision. The government employees who filed the case has .
