New Delhi: An Additional chief metropolitan magistrate has issued summons to a US company based in Pennsylvania to enable the cyber crime cell of Mumbai Police to investigate actor Hrithik Roshan’s FIR in which he claims that someone has been impersonating him on email. The FIR says the imposter was communicating with his former co-star Kangana Ranaut through the fake email id email@example.com.
The police are trying to trace the source of the email account, for which they have also asked Kangana to record her statement as a witness and to submit her computer for cyber forensic inspection. The USbased company , 1&1, Mail & Media Inc, which has been summoned, is the proprietor of email services provider Mail.com, with which the alleged fake email id of Hrithik is registered.
The summons was issued by additional chief metropolitan magistrate M R Natu on April18 on an application by the cyber police. Courts are empowered by law to issue summons for the production of any documentary evidence, even from another country, but which has areciprocal agreement to serve such summons in criminal matters. The summons may still have to be routed through the ministry of external affairs to be served on the company.
In his March 5 FIR, filed under the Information Technology Act, Hrithik said that on May 24, 2014, at a party hosted by filmmaker Karan Johar on his birthday, Kangana thanked him for appreciating her work in the movie Queen. At this, Hrithik told her he hadn’t even seen the film, to which she said, “You yourself last night told me that you had seen it thrice.”
Hrithik said in the FIR: “When I asked when and where, she replied that it was an email chat. She said it was on firstname.lastname@example.org. I said my email id is email@example.com.She then left in anger.”
Hrithik said that the next day he received an email from Kangana’s sister Rangoli, who attached a mail Kangana allegedly received from him. Hrithik said he wrote to Rangoli from his cell phone, asking if it was a joke: “I can assure you I have not sent any such mail. If you are serious, u must meet me and get to the bottom of it.”
