Shillong: The Central Bureau of Investigation (CBI) has recorded the statement of Kolkata Police Commissioner, Rajeev Kumar under section 161 of Code of Criminal Procedure (CrPC) in connection with the alleged destruction of evidence in Sarada and Rose Valley scam.
According to sources, the statement was recorded in the presence of Investigative Officer Tathagata Bardhan, Jagrup S Gusinha, Partha Mukheree and PS Kalyan.
According to CrPC, when a statement is recorded under section 161, “the person is bound to answer truly all questions relating to the case put to him by the officer, other than questions the answers to which would have a tendency to expose him to a criminal charge or to a penalty or forfeiture.”
The agency maintains that they never received the pendrive and laptop seized by J&K police from Sudipta Sen and Debjani’s possession. This was handed over to the SIT but after the Supreme Court order, the case was handed over to the CBI in 2014 but these articles were not handed over the agency.
CBI also claims that the SIT did not inform the agency that there was already an FIR against Rose Valley group in Durgapur.
CBI maintains that Rajeev Kumar’s statement, which is being recorded at the agency’s zonal office in Shillong, will be compared with the statement of others before they could be satisfied with the questioning.
According to the sources, the joint interrogation of Kunal Ghosh and Rajeev Kumar is underway.
