Kolkata: Bimal Gurung’s name was dropped from Madan Tamang charge sheet, directs court on Thursday. Court also directs to file charge sheet against forty seven persons.
Earlier, The Supreme Court on Wednesday turned down GJM leader Roshan Giri’s plea to transfer trial of Madan Tamang murder case out of West Bengal, but directed that the trial be conducted through video-conferencing after the accused, including Giri, alleged threat to their lives in Kolkata where proceedings are going on.
A bench of Justices S A Bobde and L Nageswara Rao also asked the trial court not to insist on personal appearance of the accused and witnesses in the case if it was not required.
“We direct the trial court to hold trial through video-conferencing for which facilities shall be set up in Kolkata and Darjeeling. If the trial court feels that physical presence of witnesses and accused is required then it shall pass specific order giving reasoning and granting sufficient time to them to appear in court,” the bench said.
Giri had approached the apex court seeking transfer of trial from West Bengal to Sikkim, claiming that if he was to appear in court in Kolkata to face the murder trial, there would be a serious law and order situation in the city, which might pose a threat to his life.
